OCTOBER 20, 2018 LEADERSHIP ELECTION RULES

 

The Interim Board of Governors, of the Freedom Conservative Party of Alberta (FCP), have established the following rules for its first Leadership Election.

 

Date

The FCP’s first Leadership contest will take place on October 20, 2018, with voting ending no later than 5:00 pm, and the results to be announced at approximately 6:00 pm.

 

Leadership Election Committee (LEC)

The LEC is empowered to adjudicate and make decisions regarding the Leadership Election.

Decisions made by the LEC may be appealed to the Interim Board of Governors.

 

Voters

All members in good standing by the 5:00 pm on October 6th, 2018 will be eligible to vote.

The LEC may require eligible voters to provide an electronic copy of at least one piece of government issued identification before being presented with a voting personal identification number (PIN).

 

Ballots

The Leader will be selected by a majority of eligible members who cast ballots.

In the event that no candidate receives a majority of votes on a ballot, the lowest ranked candidate shall be dropped and another ballot taken until a candidate receives a majority at a date to be determined by the LEC.

 

Voting

Eligible voting members will be provided with a PIN by the party and are only permitted to cast their own ballot with their own PIN. The PIN and voting instructions will be mailed or emailed to members by October 13th, 2018.

Eligible voting members will vote by telephone or online using their PIN.

 

Scrutineering and Integrity of Results

Up to three representatives of the Leadership campaigns and any member of the LEC may serve as scrutineers.

Paper copies of all ballots will be kept, and must not be destroyed, until the results and the integrity of the Leadership Election have been announced and established.

 

Candidate Applications

Candidates must complete a questionnaire, available upon request from the LEC, submit a criminal background check, membership signatures, and an entry fee by 5:00 pm on September 25th, 2018.

Candidates are required to submit an entry fee of $2,000.00, of which $1,000.00 shall be a refundable performance bond.

Candidates are required to submit the signatures of at least 100 members supporting their nomination on a form provided by the LEC.

The LEC will decide whether a candidate will be accepted or not, in a fair and objective process. The LEC may disallow a candidate for serious integrity or criminal issues, bankruptcies, or failure to support the FCP’s Founding Principles, or serious violation of the Leadership Election Rules.

Candidates must provide a waiver to the party authorizing the LEC to conduct a background investigation into an applicant’s financial viability, community service, credit history via Equifax, and any other such areas that the leadership committee deems relevant.

A decision to disallow a candidate must be supported by a two-thirds vote of the LEC. The decision to disallow a candidate may be appealed to the IBG and be upheld by a second two-thirds vote to stand.

The LEC may consider waiving certain requirements, on a case-by-case basis, if there is justifiable and good cause to do so.

The LEC will publicly announce the names of all accepted candidates no later than 5:00 pm on October 4th, 2018.

 

Finances

Fundraising and spending must be compliant with the Alberta Elections Act.

33 per cent of all funds raised by Leadership campaigns will levied by the party as donations.

The LEC has the right to fine campaigns for non-compliance of the Leadership Elections Rules.

 

Membership List Access

Access to an electronic party membership list will be provided to all candidates upon being accepted by the LEC.

Leadership Campaigns are required to submit any new memberships that they obtain no less than three days after the new member signs a paper or online membership form.

Memberships must be paid for by the member themselves, or a member of their immediate family or household.

 

Good Conduct 

Candidates are expected to conduct themselves in a manner that reflects positively on Alberta, and the party, and be respectful of other candidates.

 

Compliance with Elections Alberta

Candidates must meet all requirements of applicable laws and Elections Alberta regulations as follows:

A leadership contest is the procedure by which a registered party selects a new leader.

Leadership contestants are persons who seek the leadership of a registered party.

Under the Election Finances and Contributions Disclosure Act (EFCDA), Elections Alberta manages the contest, including the registration, reporting, and disclosure of information relative to the contest.

Political parties and constituency associations are responsible for notifying Elections Alberta of a contest: from when the contest will take place, to the individuals selected to run in the contest, through to the final result of the contest.

Potential contestants are responsible for also registering with Elections Alberta. This includes the appointment of a Chief Financial Officer, or CFO. A CFO is the person responsible for ensuring compliance with all aspects of campaign finance, including the filing of a campaign return.
